By accessing and using EnaQt SaaS platform ("Platform"), you ("User" or "you") agree to be bound by these Terms amd Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform.  

2. Description of Service

SkandGrace Technologies developed and offers EnaQt, a SaaS platform designed to assist organizations with regulatory compliance and sustainability reporting. The Platform's features and functionalities are subject to change or modification at our discretion.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information when creating your account.  
• You are responsible for all activities that occur under your account.  
• SkandGrace Technologies reserves the right to suspend or terminate accounts that violate these Terms.

4. User Responsibilities

• You agree to use the Platform in compliance with all applicable laws and regulations.
• You agree not to use the Platform for any illegal or unauthorized purpose.
• You are responsible for the content you upload and share on the Platform.
• You agree not to disrupt or interfere with the operation of the Platform.

5. Intellectual Property

• The Platform and its content are the property of SkandGrace Technologies and are protected by copyright and other intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose.  
• You agree not to reproduce, modify, or distribute any part of the Platform without our express written consent.
• Any data that the user inputs into the system, remains the property of the user.

6. Payment and Subscription

• The Platform is offered on a subscription basis.
• Subscription fees are due as specified in your subscription plan.
• SkandGrace Technologies reserves the right to change subscription fees.
• Failure to pay subscription fees may result in suspension or termination of your account.

7. Data Privacy

• SkandGrace Technologies collects and processes user data in accordance with our Privacy Policy.
• We take reasonable measures to protect user data, but we cannot guarantee its absolute security.

8. Disclaimer of Warranties

• The Platform is provided "as is" and "as available" without warranties of any kind.
• SkandGrace Technologies does not warrant that the Platform will be error-free or uninterrupted.
• 3rd party software that integrates with the platform, is used at the users own risk.
• We disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.  

9. Limitation of Liability  

• SkandGrace Technologies shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Platform.  
• Our liability is limited to the amount of subscription fees paid by you in the 12 months preceding the claim.

10. Indemnification

• You agree to indemnify and hold harmless SkandGrace Technologies and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Platform or your breach of these Terms.  

11. Termination

• SkandGrace Technologies may terminate your access to the Platform at any time for any reason.
• You may terminate your subscription at any time.
• Upon termination, you will no longer have access to the Platform.

12. Governing Law

• These Terms shall be governed by and construed in accordance with the laws of India.
• Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.  

13. Changes to Terms

• SkandGrace Technologies reserves the right to modify these Terms at any time.
• We will notify you of any changes by posting the updated Terms on the Platform.
• Your continued use of the Platform after any changes constitutes acceptance of the new Terms.
